Matthew J. Mussalli

Founding Attorney

Practicing since 1996. AV-Preeminent since 2005. Texas Certified Mediator.

About Matthew

Mr. Mussalli has been practicing law since 1996 and over the course of his years of practice, he has appeared in both state and federal trial and appellate courts and arbitration proceedings in Texas, New York, other states and beyond, as clients’ needs have required.

In 2005, Mr. Mussalli achieved an AV-Preeminent rating, the highest possible Martindale-Hubbell® peer reviewed rating for lawyers for both professional legal ability and ethical standards. His practice emphasizes litigation of complex business, construction, personal injury and death, and commercial disputes.

He has first and second-chaired many cases to jury verdict in various state and federal courts in Texas and New York and is often retained by other attorneys as trial counsel. Among the past cases in which Mr. Mussalli has had either primary or shared responsibility have been prosecution and defense of commercial business, shareholder and member oppression, construction, wrongful death and contested probate litigation matters. Such cases involve as few as one Plaintiff and one Defendant to as many as dozens of parties. The substantive complexity varies on a case-by-case basis, but Mr. Mussalli’s diverse background and ability to get to the heart of the controversy and determine leverage points aids clients very well.

Trials and representative cases

Two construction disputes involved marine rigs. One involved the Deepwater Nautilus, sister vessel to the Deepwater Horizon, and the other concerned the Pride Kansas. Both cases involved extensive analysis of critical path failures, coordination of trades and substantial damages and financial exposure.

In a jury trial spanning over three weeks, in the 165th Judicial District, Harris County, Texas, prosecuted by a 170 lawyer firm and defended by Mr. Mussalli, Plaintiffs sought damages exceeding $9.4 Million (of which over $900,000 were sought in attorney’s fees) for alleged breach of contract, violation of the Texas Deceptive Trade Practices Act and Fraud against The Mussalli Law Firm’s client. As many as six different lawyers prosecuted the case. Following deliberations, the jury awarded a net award of only thirty cents for breach of contract damages, as well as $5,000 for attorney’s fees, but also found that both Plaintiffs (husband and wife) materially breached the contract first, found that no fraud was committed and made an award of $11,030.60 for DTPA damages.

In post-verdict motions, the trial court granted a Take Nothing Judgment in favor of The Mussalli Law Firm’s client, under which Plaintiffs received zero damages on all causes of action.

Every matter is different. Past results do not guarantee a similar outcome.

Alternative dispute resolution

Mr. Mussalli has extensive experience in alternative dispute resolution of cases through mediation and binding arbitration under the International Chamber of Commerce (ICC) and American Arbitration Association (AAA) rules. He is a Texas Certified Mediator, having completed his mediation training at the A. A. White Dispute Resolution Center, University of Houston Law Center.
