Our Four Step Formula
We go ahead of you, in the same four steps every time.
We are in a service industry. That calls for practical, solution-generating, forward-thinking and efficient, time-sensitive work, so you can see the way ahead before you take it.
Step 1 of 4
Listen
We listen to our clients, judges, opposing counsel, adverse witnesses and of course, our jurors.
“Although we are very proud of our ability to advocate orally and in writing for our clients, it is in the art of listening that we truly excel and get to know our clients, inside and out.”

Step 2 of 4
Analyze
We know what information is most critical to our client’s cause, what to ask and how best to inquire, so we can get to the heart of the controversy and determine the leverage points.
Step 3 of 4
Plan
Strategic planning and intense, targeted preparation, so you know your options and your risks before costs build up.

Step 4 of 4
Execute
Practical, solution-generating, forward-thinking and efficient, time-sensitive execution, whether we’re in the boardroom or the courtroom.
The outcome
One trial, from the claim to the judgment.
Stage 1: Claimed
More than $9.4 Million
Sought for alleged breach of contract, violation of the Texas Deceptive Trade Practices Act and fraud, including over $900,000 in attorney’s fees.
Stage 2: Brought by
A 170‑lawyer firm
As many as six different lawyers prosecuted the case against the firm’s client.
Stage 3: Trial
Over three weeks
A jury trial in the 165th Judicial District, Harris County, Texas, defended by Matthew J. Mussalli.
Stage 4: Verdict
Thirty cents
The jury’s net award for breach of contract damages, with $5,000 in attorney’s fees and $11,030.60 in DTPA damages. It found both Plaintiffs materially breached the contract first, and that no fraud was committed.
Judgment
Zero damages on all causes of action.
In post-verdict motions, the trial court granted a Take Nothing Judgment in favor of The Mussalli Law Firm’s client.
The same preparation goes into construction disputes. Two involved marine rigs: the Deepwater Nautilus, sister vessel to the Deepwater Horizon, and the Pride Kansas, with extensive analysis of critical path failures, coordination of trades and substantial financial exposure.
Every matter is different. Past results do not guarantee a similar outcome.
Large firm complex case experience.
Small firm individual attention, responsiveness & fees.
